Limited One Year Warranty

Warranty Statement and Governing Terms

The following Limited One Year Warranty sets forth the sole, exclusive, and complete warranty provided by Prestige Contractors, Inc. (“Contractor”) in connection with construction and remodeling services performed pursuant to a written contract.

This Warranty is incorporated by reference into and forms a part of all applicable contracts between Prestige Contractors, Inc. and its customers, unless expressly modified by a written agreement signed by both parties.

 

Superseding Warranty Notice

This Limited One Year Warranty supersedes, replaces, and overrides any and all prior or contemporaneous warranties, representations, statements, descriptions, proposals, marketing materials, website content, emails, text messages, advertisements, or oral statements—whether express or implied—previously issued or published by Prestige Contractors, Inc., to the fullest extent permitted by applicable law.

Any prior references to a “lifetime warranty,” “limited lifetime warranty,” or similar term are hereby expressly disclaimed, deemed void, and of no force or effect.

No employee, agent, subcontractor, or representative of Prestige Contractors, Inc. has authority to modify, extend, or expand this Warranty except by a written agreement signed by an authorized officer of Prestige Contractors, Inc.

 

Limited One Year Warranty

1.1 Prestige Contractors, Inc. warrants that its work will be performed in accordance with industry standards and in compliance with all applicable laws. Prestige Contractors, Inc. will correct any of its work that does not comply with the requirements of the contract, subject to the conditions and limitations listed below. Alternatively, Prestige Contractors, Inc. may hire another company to perform Prestige Contractors, Inc.’s warranty work. The decision as to whether Prestige Contractors, Inc. or another company performs Prestige Contractors, Inc.’s warranty work shall be made exclusively by Prestige Contractors, Inc. If Customer or its agent repairs or replaces Prestige Contractors, Inc.’s work without first notifying Prestige Contractors, Inc. and giving them the opportunity to rectify the issue, Customer shall not be entitled to any reimbursement from Prestige Contractors, Inc.

 

1.2 This Standard Limited One Year Warranty applies and is limited as follows:

 

  • 1.2.1. To the property only as long as it remains in the possession of the original owner named in the contract.
  • 1.2.2. To the construction work that has not been subject to accident, misuse or abuse.
  • 1.2.3. To the construction work that has not been modified, altered, defaced, or had repairs made or attempted by others.
  • 1.2.4. To the materials supplied by the contractor and installed by the contractor or contractors hired subcontractors. Any materials not supplied by contractor are not subject to warranty. Any labor done by homeowner is not subject to warranty. All product /manufacturer warranties cover the product itself. When in question we will default to industry standards put in place by industry leaders such as the NARI, NKBA, TCNA, MIA, NSI and the International Building code.
  • 1.2.5. That contractor be immediately notified in writing within ten (10) days of first knowledge of defect by owner or his agent.
  • 1.2.6. That contractor shall be given first opportunity to make any repairs, replacements or corrections to the defective construction at no cost to owner within a reasonable period of time.
  • 1.2.7. Under no circumstances shall contractor be liable by virtue of this warranty or otherwise for damage to any person or property whatsoever for any special, indirect, secondary or consequential damages of any nature however arising out of the use or inability to use because of the construction defect.

 

1.3 Full Payment as Condition Precedent. Full payment of the undisputed portions of Prestige Contractors, Inc.’s final invoice within 30 days of the date on the final invoice is a condition precedent to the operation of Prestige Contractors, Inc.’s warranty. If Customer disputes Prestige Contractors, Inc.’s final invoice in good faith and Customer desires to not fully pay Prestige Contractors, Inc.’s final invoice, but desires to have the warranty, then Customer shall deposit the unpaid balance with a third party mutually agreed upon in writing between the parties to remain there until written agreement between the parties or the order a of court of competent jurisdiction. If Customer does not pay the full balance of the final invoice to Prestige Contractors, Inc. or deposit said funds in the manner described within 30 days after the date of Prestige Contractors, Inc.’s final invoice, then Prestige Contractors, Inc.’s warranty is null and void and Customer forfeits any breach of warranty claim that Customer might otherwise have.

 

1.4 Additional Three Months for Lawsuit Filing. Any lawsuit that is filed against Prestige Contractors, Inc. alleging a breach of warranty must be filed in a court of competent jurisdiction within the statute of limitations period provided by applicable law no later than three months after initial notification of warranty claim, otherwise it shall be time-barred.

 

1.5 Manufacturer’s Warranty. Prestige Contractors, Inc.’s warranty applies to Prestige Contractors, Inc.’s workmanship only. Prestige Contractors, Inc.’s warranty does not apply to any manufactured item such as appliances, fixtures or products. Such products shall be covered by the manufacturer’s warranty only.

 

1.6 The warranties contained herein are in lieu of any other applicable warranties expressed or implied to the extent permitted by applicable law.

 

1.7 Damage to property or contents from electrical surges, power grid surges, brownouts or lightning is not covered by any warranty expressed or implied.

 

1.8 Contractor is not responsible for the coloration, discoloration, oxidation, batch blending color, wood grain variation, wood tone, color and texture variation, or other aesthetic color or texture continuity of materials (either manufactured or natural) used, applied or installed in the construction of the home.

 

1.9 Contractor warrants that the materials and finishes used in the construction of the home are of commonly acceptable quality at the time of installation. Weather exposure (ice, pine needles, rain, snow, sun, temperature, wind, humidity, etc.) will cause materials and finishes to change color, crack, oxidize, swell, shrink and stain. Owner is responsible to continually inspect and monitor both interior and exterior conditions and conduct maintenance and repair work as needed. Contractor does not warranty anything that is not under the direct foreseeable control of Contractor, his subcontractors, and employees, given commonly acceptable practices and conditions at the time of installation. Contractor will not be responsible for wood shrinkage and caulking cracks. Contractor does not warrant against damage caused by ice damage or snow and ice buildup on decks or around the house.

 

No Expansion or Modification of Warranty

The posting of this Limited One Year Warranty on Prestige Contractors, Inc.’s website is for informational and reference purposes only and does not expand, modify, amend, or waive any terms, conditions, limitations, or exclusions contained herein.

 

Governing Effect

In the event of any conflict between this Warranty and any other document, communication, or representation not expressly incorporated into a signed written contract, this Limited One Year Warranty shall govern, subject to applicable law.

Effective Date: January 1, 2026 

 

Warranty Claims Notice

All warranty claims must be submitted in writing and in strict compliance with the terms of this Limited One Year Warranty.
